Contract Procurement, Formation & Negotiation
Our group advises large and small businesses, not-for profit organizations and educational institutions on issues related to teaming and strategic alliance agreements and helps them deal with actual or potential conflicts of interest, cost and pricing issues and protection of proprietary information and technology.
We also work with clients in the field of disaster relief assistance. We've assisted private companies, state and territorial governments and not-for-profit entities in obtaining FEMA grants and negotiating contracts between and among FEMA grant recipients, sub-recipients, contractors and subcontractors. We've handled projects like rebuilding public and private buildings destroyed by natural disasters and projects involving debris cleanup and proactive hazard mitigation.
Contract Performance & Compliance
Many issues can come up during the performance of a federal, state or local contract. Our attorneys and professionals work to resolve performance issues before they result in costly and time-consuming formal claims and disputes, but we're experienced in litigating these issues or pursuing ADR if negotiation fails.
We strive to help clients understand the laws, rules and regulations they must comply with to perform their government contracts, grants, cooperative agreements and subcontracts. We develop, review and update compliance programs, and we identify and address risk areas. For instance, recent legislation requires contractors to have an appropriate code of conduct, a statement of ethics, policies and procedures, hotline programs, compliance training, and an audit program. We make sure our clients know about developments like this and remain ahead of the curve.
Contract Litigation, Arbitration & Investigations
Our group includes experienced litigators who have represented clients before the U.S. Court of Federal Claims and both the Armed Services Board of Contract Appeals (ASBCA) and the Civilian Board of Contract Appeals (CBCA). We've also represented clients before federal, state and appellate courts and in internal, civil and criminal grand jury and agency investigations.
Our clients range from large defense contractors to mid-sized technology firms to small corporations and disadvantaged businesses. They supply everything from major weapons and defense systems to data processing and integration systems, security services and maintenance services for defense and civilian facilities. We also serve both prime and sub-contractors in their business dealings under government contracts.
We're particularly strong in our litigation of terminations, construction-related disputes and disaster recovery work. We handle breach of contract cases, and we pursue actions against the government under the Federal Tort Claims Act. We defend companies in personal injury and property damage cases, and we handle class action cases and suits between private parties at all levels of subcontracts under government prime contracts.
